A lot of people do not know this, but when somebody who is not a resident of Canada sells a property significant tax implications apply. In particular, anywhere from 50% to 25% of the purchase price has to be held back until the seller gets what is called the section 116 tax clearance certificate. This can have significant implications if the seller does not have at least 50%/25% equity in the property. Any time a non-resident is selling a property serious consideration of the issue of the holdback should be discussed with the lawyer handling the sale and the accountant.
